Will I still have to go to court if the case settles in mediation?

It depends on the type of case. In divorce cases, normally at least one party has to attend a hearing and have the court never the Final Decree of Divorce. The mediator will prepare a mediated settlement agreement that outlines the terms of the settlement. This is filed with the court but a formal order for the judge’s signature must also be prepared, signed by both parties and their counsel and submitted to the court. If no testimony is and if no testimony is required, the signed order can simply be filed with the court and signed at the judge’s convenience.
