Does a person have a legal duty to cooperate in an investigation of child abuse or neglect?
If the person’s refusal poses a threat to the child’s safety, the state department or agency can obtain a court order compelling that cooperation. Failure to comply with the court’s order is punishable by a contempt which may include court costs, attorney’s fees and possible incarceration of the non-complying person. A person who receives notice of a child abuse investigation but does not respond within a reasonable time may be deemed to have refused to cooperate.
