The legal definition of child abuse extends beyond mere physical injury to or neglect of a child. It includes mental or emotional injury that results in observable and material impairment in the child’s growth, development or psychological functioning. Causing or permitting the child to be in a situation where the child sustains mental or emotional injury that results in observable and material impairment in the child’s growth, development or psychological functioning. Failure to make reasonable efforts to prevent another person from harming a child is also legally abuse. This includes neglect or sexual conduct harmful to the child’s welfare.
