May a parent lawfully refuse psychological or psychiatric treatment for a child?
By itself, such refusal, including the refusal to allow the use of psychotropic drugs does not constitute neglect unless the refusal to consent presents a substantial risk of death disfigurement or bodily injury to the child or results in an observable and material impairment to the growth, development or functioning of the child. The law presumes that the parents always act in the best interest of the child and courts are reluctant to intervene unless the child’s welfare is in danger.
