Child custody and domestic violence, domestic abuseWhat actions can a parent take to protect a child if a child has been abused or neglected by the other parent?

A protective order is appropriate under these circumstances and can be obtained ex parte, that is, without the presence of the party accused if the evidence is sufficient. This order will immediately halt all right of possession and access to the child. The order is valid for two years and can be extended. An emergency motion to modify is another option and will suspend or terminate the offending parent’s rights of possession and access. The court may also order counseling and make whatever further orders deemed necessary for the protection of the child.
