Are law enforcement agencies informed of the issuance of a protective order?
Law enforcement agencies are required to enter the information regarding the issuance of a protective order into the Department of Public Safety’s statewide computer system within ten days of receiving the order from the clerk of the court. This prevents the person covered by the order from purchasing a firearm for the duration of the order.
Attempting to purchase a firearm while subject to a protective order is a criminal offense under both state and Federal law. If the protective order also excludes the person from the residence, law enforcement personnel will accompany the applicant to the residence, inform the respondent that the court has ordered that he be excluded from the residence and protect the applicant while she takes possession of the residence.
If the respondent fails to vacate the premises, the officer will remove him from the premises and arrest him for violating the court’s order.
