Can a protective order issued in another state be enforced or modified in Texas?
Just as any other order, foreign protective orders can be enforced in Texas. A certified copy of the order should be obtained from the issuing court and filed with the sheriff, constable or chief of police responsible for the registration of orders in the local computer records and in the statewide law enforcement system maintained by the Texas Department of Public Safety. The certified copy may also be presented to the Texas Department of Public Safety with a request that to be registered in the statewide law enforcement system maintained by the Texas Department of Public Safety. The person filing the order shall file a sworn affidavit that made by the protected person stating that, to the best of the protected person’s knowledge, the order is in effect.
The order can be enforced judicially or non-judicially if the officer has probable cause to believe that a foreign protective order exists and has been violated.
