Restraining or protective orders, smith and garg family attorneysWhat does a party have to do to obtain a restraining order in a divorce case?

Upon the filing of the divorce, a party can obtain a temporary restraining order without notice to the other party.  The purpose of the order is to preserve property and protect persons pending an evidentiary hearing with both parties before the court.  The temporary restraining order is good for fourteen days and may be extended for an additional fourteen day period.
