Can a temporary restraining order be used to prevent one parent from leaving the state or the country with the child?
One of the first things that we try to do when trying temporary orders is to have the court order that our client has the exclusive right to determine the child’s residence. Typically, this will be the parent with who the child will primarily reside. The residence is usually limited to a particular county or area. The court has the authority to order that the child not be removed from the court by either parent without the court’s permission. This prevents one parent from using the children as pawns as they are all too often.
