Temporary Orders - FAQ's

Faq's

temporary orders, divorce attorneys

If a party is dissatisfied with the court’s ruling on a temporary order, is that ruling appealable to a higher court?

Rulings on temporary orders, other than an order appointing a receiver, are not appealable to a higher court.  Generally, only final orders such as a final decree of divorce are appealable.  However, mandamus is available to correct an abuse of discretion by the trial court.  The judge has considerable discretion and to reverse the court, a party must show a clear abuse of that discretion which is a difficult burden.
