Temporary Orders - FAQ's

Faq's

temporary orders, divorce attorneys

What is the remedy where a party has violated a temporary order?

Violation of a temporary injunction, temporary restraining order or other temporary order is punishable by contempt.  While the United States Constitution and the Texas Constitution prohibit imprisonment for a debt, the courts have held that temporary spousal support and child support are not debts.  Rather, the obligation arises as a result of the status of the parties and so maybe enforced by incarceration.  A refusal to obey a temporary order regarding the payment of attorney’s fees where ordered as temporary support is also punishable as a contempt.
