What is the purpose of obtaining temporary orders?
Temporary orders are issued for a variety of reasons but mostly make certain
rulings as to the community estate and children. The community estate consists of all the property acquired by the parties during the marriage. Exceptions to this general rule are property acquired by a party by means of gift, devise or descent. If there are children, temporary support will establish temporary child custody and support as well as visitation. Such orders may also order the payment of temporary spousal support and interim attorney’s fees. If there has been substantial discord between the parties, the temporary orders may also include injunctions prohibiting the parties from harassing, threatening one another, disconnecting the utilities of the other party and other disruptive conduct.
